TERMS AND CONDITIONS
1. BraaiBQ Catering and Training (Referred as BBQT in these T&C) and trading as BraaiBQ Catering are the supplier and all agreements made are between BBQT and you (referred to as the client in these T&C, whether you are private and /or business or on behalf of a business, or any entity requesting and ordering BBQT services. When signing on behalf of a company or business or charity or third party, you as an individual are confirming your authorisation and their agreement to sign on their behalf, and in so the contract Terms and Conditions (Referred as T&C) will be deemed as 'agreed' by yourself with authorisation of such establishments.
2. All communications are treated as enquiries, and ALL enquiries/bookings remain provisional and unconfirmed until the required deposit is received by BBQT as per BBQT payment terms (see 4a;b;c;d) and a signed contract has been returned to us.
3. Holding a preferred date: If your enquiry is first for a preferred date, BBQT will put on hold the availability of your preferred date for an agreed period, which will be communicated to yourself during enquiry communications. However our Terms and Conditions(see2) above supersede any other verbal confirmations and or other agreements of any specific days, dates or information.
4. Payment Terms:
a) A 50% non-refundable deposit is required to secure and confirm the booking.
b) The outstanding balance of the contracted quote is due as cleared funds into BBQT bank account, no later than 14 days (Fourteen) prior to the event date.(BBQT reserve the right to choose not to begin catering if the payment terms are not met),and the booking will be treated with the same terms and conditions as a cancelled booking.(see 5a;b)
c) When paying by cheque, they must be made out to BraaiBQ Catering, and issued allowing sufficient time to clear into our account.
d) Any extra cost due for billing post event is required to be paid within 7 days (seven) of post event invoice date
e) As per prevailing percentage and ruling of ‘Late Payment of Commercial Debts (Interest) Act 1998’, we reserve
our rights to charge interest for any late payments outside of our agreed payment terms set out in these T&C
5. Cancellation Policy:
a)2 and 3 Months(inclusive) before event date – 50% of contract agreement.(i.e. Deposit already paid at booking)
b)Day of event to 1 Month (inclusive)before event date - 100% of contract agreement (i.e. an invoice for the balance would be raised if cancelled for 50% balance outstanding.)The same payment terms as listed in 4.d above apply.
6. Your event venue: Our Hog Roast Ovens external dimensions are: 2060mm x 680mm x 965mm (LxWxH) and are either gas or charcoal machines Our BBQ are either gas or charcoal machine. Whilst our best precautions are taken when using charcoal, not to drop coal and /or damage the grass or standings, BBQT can never guarantee this not to happen, and cannot accept liability to damages this may leave. If there are steps, on occasion we may need to request assistance to carry the machine, or relocate the machine to a more accessible position.
Please ensure that access to your venue allows for the unit to be wheeled through.
Please ensure a parking for our vehicle is made available with easy access and exit to and from the venue. If parking permits are required, these arrangements and payments are for the client to arrange and make available for our arrival.
Access to an electric supply must be made available by the client for us, which is required for lighting and to operate the rotisserie motor
The client must make available access to a water supply for us.
On confirming the booking by the client, BBQT act in good faith and belief that the client has all required permissions and rights to use the venue, as well as for us to cater there. BBQT will not be liable or accept any responsibility if the venue deny us access and resulting in been unable to cater the event.
The client MUST in writing inform BBQT when the contract is been issued if any of these requirements cannot be met by the client, and the client must insist on a written confirmation from BBQT to confirm us been aware of any issues. At times some extra charges may apply if BBQT need to cover these arrangements ourselves. This will be discussed with the client initially to see if other arrangement /solutions could be found with no charges.
7. Equipment Hire: When BBQT, supply any cutlery or crockery or any other equipment which is not within the quoted menu price, then a hire charge will apply. BBQT will be responsible for the clearing and cleaning, the equipment. The client will be responsible for any breakages, losses and /or damages to any of the hired order and will be invoiced for any replacement costs post event. If equipment is within the menu price, then no extra hire charge applies, however losses, damage/breakage charges will apply.
8. Staff: When staff is within the quoted price, this will be noted on the contract. Any further staff required will be charged on and hourly rate, with minimum 4 hour charge per staff member.
9. General Liability: BBQT do not accept any liability if we are unable to provide the contracted service due to any circumstances which are out of our control including(but not limited to) water or electricity problems, fire evacuations or access to site problems. BBQT always allow sufficient travel time to site and set up time, however cannot be held liable for any failed delivery or late start times due to unforeseen traffic or vehicle problems or any other unforeseen event.
10. Travel: Our first 25 miles are included in all quotes. Any travel over the 25 miles will incur a cost of 0.60p per mile
11. Force Majeure: BBQT shall not be regarded as being in breach or liable to the client for any loss or damage or injury caused as a direct or indirect result of the performance of any obligation under these terms and conditions been prevented, hindered or delayed by any event or circumstance beyond reasonable control of BraaiBQ Catering, including, but not limited to fire, flood, storm, volcanoes, act of god, war, strikes, trade disputes or other industrial action.
12. These T&C‘s the validity and construction and performance of the contract shall be governed by the laws of England and both parties (BBQT and The Client) agree to submit to the exclusive jurisdiction of the English Courts.
